These Terms and Conditions govern your use of charmedgiraffe ("the service"), operated by charmedgiraffe, Porto, Portugal. By creating an account or using the service, you agree to these terms. Please read them carefully.
1. The service
charmedgiraffe is a free city-guide and event-discovery service for Porto, Portugal. We curate and aggregate information about events, concerts, exhibitions, and experiences in Porto, and deliver a personalised digest to subscribers by email or WhatsApp. The service is provided free of charge to members.
2. Eligibility
You must be at least 16 years old to use charmedgiraffe. By using the service you confirm that you meet this requirement. If you are under 16, please do not create an account.
3. Your account
Authentication is handled via magic links sent to your email address. You are responsible for keeping access to your email account secure. You may not share your account or magic links with others. We reserve the right to suspend or terminate accounts that appear to have been compromised or used in violation of these terms.
4. Content accuracy
charmedgiraffe aggregates event information from a variety of public sources. We aim to keep event listings accurate and up to date, but we cannot guarantee that all information (including dates, times, ticket availability, or pricing) is correct at the time you read it.
charmedgiraffe is not an event organiser or ticket retailer. Always verify event details directly with the organiser before making travel arrangements or purchasing tickets. We accept no liability for loss or inconvenience arising from inaccurate event information.
5. Acceptable use
You agree not to use charmedgiraffe in any way that:
- Violates any applicable law or regulation.
- Infringes the intellectual property rights of charmedgiraffe or any third party.
- Involves scraping, crawling, or systematically downloading content from the service without our prior written consent.
- Involves automated or bulk sign-ups, or creating accounts on behalf of others without their consent.
- Transmits spam, unsolicited messages, or malicious code.
6. No commercial resale
The content provided by charmedgiraffe — including event listings, editorial copy, and digest emails — is for personal, non-commercial use only. You may not reproduce, redistribute, resell, or commercially exploit any content from charmedgiraffe without our prior written permission.
7. User contributions
By submitting event suggestions or other content through charmedgiraffe, you grant us a non-exclusive, royalty-free licence to use, edit, and publish that content as part of the service. You warrant that you have the right to submit the content and that it does not infringe any third-party rights or violate any law.
8. Intellectual property
All intellectual property in charmedgiraffe — including the charmedgiraffe name, logo, website design, and editorial content — belongs to charmedgiraffe or its licensors. Nothing in these terms grants you any ownership rights in our intellectual property.
9. Third-party links
charmedgiraffe links to external websites and event pages operated by third parties. We have no control over those websites and accept no responsibility for their content, privacy practices, or availability. Links to external sites do not imply endorsement.
10. Limitation of liability
To the fullest extent permitted by Portuguese law, charmedgiraffe is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, or consequential loss arising from your use of, or inability to use, the service — including but not limited to missed events, travel costs, or ticket purchases made in reliance on inaccurate listing information.
11. Termination
You may delete your account at any time from your profile settings. We reserve the right to suspend or terminate your access to charmedgiraffe at any time if you breach these terms or if we decide to discontinue the service, with or without notice.
12. Governing law
These terms are governed by the laws of Portugal. Any disputes arising from your use of charmedgiraffe shall be subject to the exclusive jurisdiction of the courts of Porto, Portugal.
13. Changes to these terms
We may revise these Terms and Conditions from time to time. We will update the date at the top of this page and, for material changes, notify you by email. Continued use of the service after changes are published constitutes acceptance of the updated terms.
